His lawyers fucked up and the judge, not a jury, gets to decide liability. Really stupid to attack the person in charge of the ultimate outcome of your case.

Iirc liability and damages usually go to the jury and there’s only very specific circumstances based in law where the judge can take over liability, so that might be really interesting.
